Decree of the Government of the Russian Federation of April 19, 2012 N 349
"On licensing activities for the preservation of cultural heritage sites (historical and cultural monuments) of the peoples of the Russian Federation"

In order to implement the Federal Law "On Licensing of Certain Types of Activities", the Government of the Russian Federation decides:

1. Approve the attached Regulations on licensing activities for the preservation of cultural heritage sites (historical and cultural monuments) of the peoples of the Russian Federation.

2. Introduce the following changes to the Regulations on the Ministry of Culture of the Russian Federation, approved by Decree of the Government of the Russian Federation of July 20, 2011 N 590 (Collected Legislation of the Russian Federation, 2011, N 31, Art. 4758):

a) subclause 5.4.4 should be stated as follows:

"5.4.4. licensing of activities for the preservation of cultural heritage sites (historical and cultural monuments) of the peoples of the Russian Federation;";

4. The implementation of the powers provided for by this resolution is carried out within the limits of the maximum number of employees of the Ministry of Culture of the Russian Federation established by the Government of the Russian Federation, as well as within the limits of budgetary allocations provided for the Ministry in the federal budget for leadership and management in the field of established functions.

With changes and additions from:

1. These Regulations determine the procedure for licensing activities for the preservation of cultural heritage objects (historical and cultural monuments) of the peoples of the Russian Federation (hereinafter referred to as objects), carried out by legal entities and individual entrepreneurs.

2. Licensing of activities for the preservation of objects is carried out by the Ministry of Culture of the Russian Federation (hereinafter referred to as the licensing authority).

4. The licensing requirements for a license applicant (licensee) to carry out activities to preserve objects are:

a) to perform the work specified in paragraphs 1, 3 - 10 of the list given in the appendix to this Regulation:

for a legal entity - the presence on the staff of the license applicant (licensee) of at least 3 employees holding managerial positions (general director (director), his deputies, chief engineer, chief architect, work manager, head of department), responsible for the implementation of licensed activities, passed certification in the field of conservation of objects in the manner established by the Ministry of Culture of the Russian Federation, and having work experience in the field of conservation of objects necessary to carry out the declared work for at least 3 years over the last 10 years;

for an individual entrepreneur - passing certification in the field of preservation of objects in the manner established by the Ministry of Culture of the Russian Federation, as well as having work experience in the field of preservation of objects necessary to carry out the declared work for at least 3 years over the last 10 years or employees who have entered into a contract with the individual entrepreneur employment contracts and corresponding licensing requirements for a license applicant (licensee) - an individual entrepreneur;

b) to perform the work specified in paragraphs 2 and the list given in the appendix to this Regulation:

for a legal entity - the presence on the staff of the license applicant (licensee) of at least 3 employees holding managerial positions (general director (director), his deputies, chief engineer, chief architect, work performer), responsible for carrying out the licensed activity, having a professional education, having the appropriate qualifications and having work experience in the field of conservation of objects necessary to perform the declared work for at least 3 years over the last 10 years;

for an individual entrepreneur - the presence of professional education, appropriate qualifications and work experience in the field of conservation of objects necessary to perform the declared work, for at least 3 years over the last 10 years, or employees who have concluded employment contracts with the individual entrepreneur and meet the licensing requirements for the license applicant (licensee) - individual entrepreneur;

c) the licensee carries out work to preserve objects in the manner established by Article 45 of the Federal Law “On objects of cultural heritage (historical and cultural monuments) of the peoples of the Russian Federation.”

5. Gross violations of licensing requirements include violations of the requirements provided for in subparagraphs “a”, “b” and “c” of paragraph 4 of these Regulations, entailing the consequences established by Part 11 of Article 19 of the Federal Law

6. To obtain a license, the license applicant (licensee) sends or submits to the licensing authority an application and documents (copies of documents) specified in Part 1 and Clause 4 of Part 3 of Article 13 of the Federal Law “On Licensing of Certain Types of Activities”, as well as:

a) copies of documents or duly certified extracts from documents confirming that the license applicant (licensee) - a legal entity has employees specified in paragraph two of subparagraph "a" of paragraph 4

b) copies of documents or duly certified extracts from documents confirming that the license applicant (licensee) - individual entrepreneur has the required work experience in the field of preservation of objects or the presence on the staff of the individual entrepreneur of the workers specified in paragraph three of subparagraph "a" of paragraph 4 of this Regulations, as well as whether such employees have relevant work experience;

c) copies of documents or duly certified extracts from documents confirming that the license applicant (licensee) - a legal entity has a staff of employees specified in paragraph two of subparagraph "b" of paragraph 4

d) copies of documents or duly certified extracts from documents confirming that the license applicant (licensee) - an individual entrepreneur has professional education, qualifications, relevant work experience or the presence on staff of employees specified in paragraph three of subparagraph "b" of paragraph 4 of these Regulations , as well as the availability of such employees with appropriate professional education, qualifications and work experience;

7. Submission by the license applicant of an application and documents necessary to obtain a license, their acceptance by the licensing body, the licensing body making a decision to grant a license (refusal to grant a license), re-registration, suspension, renewal of its validity, provision of a duplicate and copy of the license, as well as maintenance of the information resource and register of licenses, provision of information contained in the information resource and register of licenses are carried out in the manner established by the Federal Law “On Licensing of Certain Types of Activities”.

8. If the licensee intends to carry out a licensed type of activity at the address of the place of its implementation, not specified in the license, and (or) perform new work that constitutes the licensed type of activity, this address and (or) information about the work that the licensee intends to comply, as well as information confirming the licensee’s compliance with the licensing requirements specified in paragraph 4 of these Regulations.

9. Information related to the implementation of a licensed type of activity, provided for in parts 1 and 2 of Article 21 of the Federal Law "On Licensing of Certain Types of Activities", is posted in the official electronic or printed media of the licensing authority and (or) on information stands on the premises of the licensing authority within 10 days from the date:

b) the licensing authority makes a decision on granting or re-issuing a license, suspending, renewing or terminating its validity;

c) receiving information from the Federal Tax Service on the liquidation of a legal entity or termination of its activities as a result of reorganization, on the termination by an individual of activities as an individual entrepreneur;

d) the entry into force of a court decision to revoke the license.

10. Licensing control is carried out in the manner prescribed by the Federal Law “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Exercise of State Control (Supervision) and Municipal Control”, taking into account the specifics established by the Federal Law “On Licensing of Certain Types of Activities”.

11. When checking the information contained in the application submitted by the license applicant (licensee) and the documents attached to it, the compliance of the license applicant (licensee) with licensing requirements, the licensing authority requests the information necessary for the provision of public services in the field of licensing, which is at the disposal of the bodies providing state services, bodies providing municipal services, other state bodies, local government bodies or organizations subordinate to state bodies or local government bodies, in the manner established by the Federal Law “On the organization of the provision of state and municipal services”.

12. For the provision of a license, re-issuance of a license, issuance of a duplicate license, a state duty is paid in the amounts and in the manner established by the legislation of the Russian Federation on taxes and fees.

    Pre-trial (out-of-court) procedure for appealing decisions

    and (or) actions (inaction) of the Department, its officials

    persons, government civil servants

    1. The applicant has the right to file a pre-trial (out-of-court) complaint against decisions taken (committed) in the provision of public services and (or) actions (inaction) of the Department, its officials, and state civil servants.

    2. The filing and consideration of complaints is carried out in the manner established by Chapter 2.1 of the Federal Law of July 27, 2010 N 210-FZ “On the organization of the provision of state and municipal services”, the Regulations on the specifics of filing and consideration of complaints about violations of the procedure for the provision of public services in the city of Moscow , approved by Decree of the Moscow Government of November 15, 2011 N 546-PP “On the provision of state and municipal services in the city of Moscow”, these Regulations.

    3. Applicants may file complaints in the following cases:

    3.1. Violation of the deadline for registering a request (application) and other documents necessary for the provision of public services, as well as the procedure for registration and issuance of a receipt
    in receiving a request and other documents (information) from the applicant.

    3.2. Requirements from the applicant:

    3.2.1. Documents or information or the implementation of actions, the presentation or implementation of which is not provided for by the regulatory legal acts of the Russian Federation and the city of Moscow for the provision of public services, including documents obtained using interdepartmental information interaction.

    3.2.2. Applications for the provision of services not included in the list of services approved by the Moscow Government that are necessary and mandatory for the provision of public services.

    3.2.3. Payment of fees for the provision of public services not provided for by regulatory legal acts of the Russian Federation and the city of Moscow.

    3.2.4. Documents or information, the absence and (or) unreliability of which
    were not indicated during the initial refusal to accept documents necessary for the provision of a public service, or to provide a public service,
    except for the cases provided for in paragraph 4 of part 1 of article 7 of the Federal Law
    dated July 27, 2010 No. 210-FZ “On the organization of the provision of state and municipal services.

    3.3. Violations of the deadline for the provision of public services.

    3.4. Refusal to the applicant:

    3.4.1. In accepting documents, the submission of which is provided for by the regulatory legal acts of the Russian Federation and the city of Moscow for the provision of public services, on grounds not provided for by the regulatory legal acts of the Russian Federation and the city of Moscow.

    3.4.2. In the provision of public services on grounds not provided for by the regulatory legal acts of the Russian Federation and the city of Moscow.

    3.4.3. In the correction of typographical errors and errors in documents issued as a result of the provision of public services, or in case of violation of the established deadline for such corrections.

    3.5. Other violations of the procedure for providing public services established by regulatory legal acts of the Russian Federation and the city of Moscow.

    4. Complaints about decisions and (or) actions (inaction) of officials, state civil servants of the Department are considered by its head (authorized deputy head).

    Complaints about decisions and (or) actions (inaction) of the head of the Department, including decisions made by him or his deputy on complaints received in a pre-trial (extrajudicial) manner, are considered by a higher executive body of the city of Moscow in accordance with clauses 5.6, 6 of the appendix 6 to the resolution of the Moscow Government of November 15, 2011 N 546-PP “On the provision of state and municipal services in the city of Moscow.”

    5. Complaints can be submitted to the executive authorities of the city of Moscow authorized to consider them in accordance with these Regulations (hereinafter referred to as the bodies authorized to consider complaints), in writing on paper, in electronic form in one of the following ways:

    5.1. Upon personal application by the applicant (applicant’s representative).

    5.2. By post.

    5.3. Using the official websites of bodies authorized to consider complaints on the Internet.

    6. The complaint must contain:

    6.1. The name of the body authorized to consider the complaint or the position and (or) surname, first name and patronymic (if any) of the relevant official to whom the complaint is sent.

    6.2. The name of the executive authority of the city of Moscow or the position and (or) surname, first name, patronymic (if any) of the official, state civil servant, whose decisions and (or) actions (inaction) are being appealed.

    6.3. Last name, first name, patronymic (if any), information about the place of residence of the applicant - an individual, including one registered as an individual entrepreneur, or name, information about the location of the applicant - a legal entity, as well as contact telephone number(s), address (addresses) email (if available) and postal address to which the response should be sent to the applicant.

    6.4. The date of submission and registration number of the request (application) for the provision of a public service (except for cases of appealing the refusal to accept the request and its registration).

    6.5. Information about decisions and (or) actions (inactions) that are the subject of appeal.

    6.6. Arguments on the basis of which the applicant does not agree with the appealed decisions and (or) actions (inactions). The applicant may submit documents (if any) confirming the applicant’s arguments, or copies thereof.

    6.7. Applicant's requirements.

    6.8. List of documents attached to the complaint (if any).

    6.9. Date of filing the complaint.

    7. The complaint must be signed by the applicant (his representative). If a complaint is filed in person, the applicant (applicant's representative) must provide an identification document.

    The authority of the representative to sign the complaint must be confirmed by a power of attorney issued in accordance with the legislation of the Russian Federation.

    The powers of a person acting on behalf of an organization without a power of attorney on the basis of the law, other regulatory legal acts and constituent documents are confirmed by documents certifying his official position, as well as the constituent documents of the organization.

    The status and powers of legal representatives of an individual are confirmed by documents provided for by federal laws.

    8. A received complaint must be registered no later than the working day following the day of receipt.

    9. The maximum period for consideration of a complaint is 15 working days from the date of its registration. The period for consideration of the complaint is 5 working days from the date of its registration in cases of appeal by the applicant:

    9.1. Refusal to accept documents.

    9.2. Refusal to correct typos and errors made in documents issued as a result of the provision of public services.

    9.3. Violations of the deadline for correcting typos and errors.

    10. Based on the results of consideration of the complaint, a decision is made to satisfy the complaint (in whole or in part) or to refuse to satisfy the complaint.

    11. The decision must contain:

    11.1. Name of the body that considered the complaint, position, surname, first name, patronymic (if any) of the official who made the decision on the complaint.

    11.2. Details of the decision (number, date, place of adoption).

    11.3. Last name, first name, patronymic (if any), information about the place of residence of the applicant - an individual, including one registered as an individual entrepreneur, or the name, information about the location of the applicant - a legal entity.

    11.4. Last name, first name, patronymic (if any), information about the place of residence of the applicant’s representative who filed the complaint on behalf of the applicant.

    11.5. Method of filing and date of registration of the complaint, its registration number.

    11.6. Subject of the complaint (information about the decisions, actions, or inactions being appealed).

    11.7. The circumstances established during the consideration of the complaint and the evidence confirming them.

    11.8. Legal grounds for making a decision on a complaint with reference to the applicable regulatory legal acts of the Russian Federation and the city of Moscow.

    11.9. The decision taken on the complaint (conclusion on the satisfaction of the complaint or refusal to satisfy it).

    11.10. Information on actions taken by the Department in order to immediately eliminate identified violations in the provision of public services,
    as well as an apology for the inconvenience caused and information about further actions that the applicant needs to take in order to receive a public service (if the complaint is upheld) or reasoned explanations about the reasons for the decision (in case the complaint is refused).

    11.11. Procedure for appealing a decision.

    11.12. Signature of the authorized official.

    12. The decision is made in writing using official forms.

    13. The measures to eliminate identified violations specified in the decision include:

    13.1. Cancellation of previously made decisions (in whole or in part).

    13.2. Ensuring the acceptance and registration of the request, execution and issuance of a receipt to the applicant (in case of evasion or unreasonable refusal to accept documents and their registration).

    13.3. Ensuring registration and delivery to the applicant of the result of the provision of a public service (in case of evasion or unreasonable refusal to provide a public service).

    13.4. Correction of typos and errors made in documents issued as a result of the provision of public services.

    13.5. Refund to the applicant of funds, the collection of which is not provided for by the regulatory legal acts of the Russian Federation and the city of Moscow.

    14. The body authorized to consider the complaint refuses to satisfy it in the following cases:

    14.1. Recognition of the appealed decisions and (or) actions (inactions) as legal and not violating the rights and freedoms of the applicant.

    14.2. Filing a complaint by a person whose powers have not been confirmed in the manner established by regulatory legal acts of the Russian Federation and the city of Moscow.

    14.3. The applicant does not have the right to receive public services.

    14.4. Availability:

    14.4.1. A court decision on the applicant’s complaint with identical subject matter and grounds that has entered into legal force.

    14.4.2. Decisions on a complaint made earlier in a pre-trial (out-of-court) manner in relation to the same applicant and on the same subject of the complaint (except for cases of appealing previously made decisions to a higher authority).

    15. The complaint must be left unanswered on its merits in the following cases:

    15.1. The presence in the complaint of obscene or offensive language, threats to the life, health and property of officials, as well as members of their families.

    15.2. If the text of the complaint (part of it), last name, postal address and email address are not readable.

    15.3. If the complaint does not indicate the name of the applicant (the applicant's representative) or the postal address and email address to which the response should be sent.

    15.4. If the body authorized to consider the complaint received a request from the applicant (the applicant’s representative) to withdraw the complaint before a decision on the complaint is made.

    16. The decision to satisfy the complaint or to refuse to satisfy the complaint is sent to the applicant (the applicant’s representative) no later than the working day following the day of its adoption, to the postal address specified in the complaint. At the request of the applicant, the decision is also sent to the email address specified in the complaint (in the form of an electronic document signed with the electronic signature of an authorized official). In the same manner, the applicant (the applicant’s representative) is sent a decision on the complaint, in which only an email address is indicated for the response, and the postal address is missing or cannot be read.

    17. If the complaint is left unanswered on the merits, the applicant (his representative) is sent, no later than the working day following the day of registration of the complaint, a written motivated notification indicating the grounds (except for cases where the postal address and email address are not indicated in the complaint email for a response or they are unreadable). The notice is sent in the manner established for sending a decision on a complaint.

    18. A complaint filed in violation of the rules on competence established by paragraph 5.4 of these Regulations is sent no later than the working day following the day of its registration to the body authorized to consider the complaint, with simultaneous written notification to the applicant (his representative) about the redirection complaints (except for cases where the complaint does not indicate a postal address and email address for a response or they are not legible). The notice is sent in the manner established for sending a decision on a complaint.

    19. Filing a complaint in a pre-trial (out-of-court) manner does not exclude the right of the applicant (applicant’s representative) to simultaneously or subsequently file a complaint in court.

    20. Informing applicants about the judicial and pre-trial (extrajudicial) procedure for appealing decisions and (or) actions (inaction) committed in the provision of public services should be carried out by:

    20.1. Placing relevant information on the Portal of state and municipal services (functions) of the city of Moscow and stands in places where public services are provided.

    21. If, during or as a result of consideration of a complaint, signs of an administrative offense or crime are established, the official empowered to consider the complaint immediately forwards the available materials to the prosecutor’s office.

    2. Termination or suspension of one or more documents necessary for the provision of public services.

    3. The applicant submitted an incomplete set of documents that are subject to mandatory submission by the applicant.

    4. The submitted documents contain unreliable and (or) contradictory information.

    5. The application was signed and (or) submitted by an unauthorized person.

    6. Application for the provision of a public service by a person who is not a recipient of the public service in accordance with the Regulations for the provision of the service.

    7. The applicant’s application for a public service, the provision of which is not carried out by the Department or is carried out in accordance with other administrative regulations for the provision of public services.

    Grounds for refusal to provide services

    1. Grounds for refusal to accept documents necessary for the provision of public services, if they are identified after acceptance of the application and other documents necessary for the provision of public services.

    2. The types of work specified in the application for a permit do not correspond to the previously agreed project documentation for the preservation of the cultural heritage site.

    3. Suspension of activities (liquidation) of the legal entity - the applicant.

    4. The applicant does not have a license to carry out work to preserve cultural heritage sites, or the types of work specified in the application for a Permit are not included in the applicant’s license to carry out such work.

    5. Non-compliance of documents with the requirements of Articles 5.1, 36, 40, 41, 42, 45, 47.2, 47.3 of the Federal Law of June 25, 2002 No. 73-FZ “On objects of cultural heritage (historical and cultural monuments) of the peoples of the Russian Federation.”

    SRP-2007.4.1

    Introduction

    These recommendations were developed in connection with the adoption of the Federal Law “On objects of cultural heritage (historical and cultural monuments) of the peoples of the Russian Federation” dated June 25, 2002 No. 73-FZ and the Code of Restoration Rules (SRP-2007).

    The recommendations define the tasks of restoration, establish the procedure for organizing and conducting research, restoration, emergency and preventive work on cultural heritage sites - monuments of monumental sculpture.

    1. Terms and definitions

    1.1. Monuments of monumental sculpture: Monumental sculptural works created to perpetuate people or historical events and monumental decorative arts, found in the open air, made of various materials.

    1.2. Subject of protection of monumental sculpture: features of the original appearance of the monument and the elements that make up the ensemble of the monument, which served as the basis for inclusion in the list of cultural heritage objects and are subject to mandatory preservation.

    1.3. Restoration Council. A specially created or existing council (commission) of the state body for the protection of cultural heritage objects (or the Customer’s organization) consisting of representatives of the state body for the protection of monuments and specialists. The Restoration Council exercises scientific and methodological control over the conduct of conservation, restoration and research work directly at the site at all stages of their implementation.

    1.4. Terms of reference for carrying out work on a monument of monumental sculpture (Terms of reference). Determines the composition of research and restoration work on the monument, their volume, validity and consistency based on the decision of the restoration council. The development of the Technical Specifications is coordinated by the customer or entrusted by the customer as part of preliminary work to a contractor who has the necessary qualifications and a license for this type of work.

    1.5. Certificate of technical condition of a monument of monumental sculpture. It is compiled based on the results of preliminary work carried out with the aim of examining the monument and developing Terms of Reference. Contains the data necessary to prepare the estimated cost of work.

    1.6. Restoration technique: A document containing conclusions from the results of research work and the methodology itself, which contains recipes, methods and sequence of all conservation and restoration operations. The restoration methodology is developed by the performer (contractor) after it is determined.

    2. General provisions

    2.1. Objects of cultural heritage - monuments of monumental sculpture (MSS) include monumental sculptural works created to perpetuate people or historical events and monuments of monumental decorative art located in the open air.

    Monumental sculpture, as a form of art, combines types of structures that are different in scale, technical complexity, and plastic solutions:

    Single statues and sculptural compositions, busts, tombstones, slabs with relief or inscription, etc.;

    Unique architectural decor and sculptural compositions for building facades;

    Ensembles - memorial, park, ensembles of city monuments. The ensemble of a monumental monument includes, in addition to the sculptural dominant, such elements as fences, borders, benches, flights of stairs, cabinets, decorative vases, etc.;

    Monuments of small architectural forms - columns, obelisks, triumphal arches, lanterns, grilles, cannons, fountains, bells, etc.

    2.2. The different structural and plastic complexity of the PMS determines different options for design and execution documentation for carrying out scientific and restoration work.

    2.3. The scientific restoration of the PMS as an object of cultural heritage consists of developing a system of measures aimed at preserving the material structure of the monument, its historical, cultural and artistic features.

    2.4. Scientific restoration requires strict preservation of the technological, cultural and historical information contained in the material structure of the monument, regardless of modern aesthetic assessments. Restoration technologies, technical means and materials should not distort this information, nor prevent repeated restorations.

    2.5. The basic rule for carrying out scientific restoration work is to justify any intervention in the current state of the monument.

    2.6. One of the conditions for maintaining the exhibition appearance and ensuring the safety of a monument of monumental art is the systematic control and implementation of restoration work and preventive, routine care measures.

    3. The procedure for preparing documentation for the execution of work

    3.5. In accordance with the decision of the restoration council, the customer organizes the development of Terms of Reference for carrying out work on the monument of monumental sculpture (hereinafter referred to as the Terms of Reference). The development of the Technical Specifications is coordinated by the customer or entrusted by the customer as part of preliminary work to a contractor who has a license for this type of work (clauses - . of these Recommendations).

    The terms of reference is the main document defining the set of research and restoration work on the monument, their validity and consistency, therefore this document must be prepared by qualified specialists - restorers of monumental sculpture, with the involvement, if necessary, of architects and engineers.

    3.6. The terms of reference and the estimated cost of the work, calculated on its basis as part of the preliminary work, are published as part of the competition documentation to determine the performer (contractor) of work on the monument of monumental sculpture, or are transferred by the customer to the contractor when the work is carried out without a competition.

    3.7. The terms of reference are the basis for the restoration methodology (similar to the restoration project for architectural monuments). The restoration methodology is developed by the performer (contractor) after it is determined.

    During the restoration, the technique can be supplemented, refined or changed. Refinements or changes to the methodology are also approved at intermediate restoration councils and recorded in a protocol.

    3.8. The assignment and permission to carry out work to preserve cultural heritage sites of federal significance is agreed upon and issued by the Federal Service for Supervision of Compliance with Legislation in the Field of the Protection of Cultural Heritage and on the basis of the “Temporary Procedure for Considering Applications from Applicants and Issuing Assignments and Permits to Carry Out Work to Preserve Cultural Heritage Objects” (historical and cultural monuments) of federal significance", approved by the Order of Rosokhrankultura dated December 15, 2008 No. 10.

    3.9. The executor of restoration work can begin to carry it out after receiving a permit issued by the authorities for the protection of cultural heritage sites.

    3.10. Restoration, conservation and studies of monuments related to conservation and restoration work, as well as the preparation of scientific and restoration documentation are carried out at the expense of the customer.

    3.11. The agreement (contract), signed by the customer and the contractor, stipulates the conditions for the work, mutual obligations, financing procedures, reporting forms, start and end dates for work. The agreement (contract) is accompanied by estimates, work schedule, licenses, if necessary, a protocol of disagreements and other documents.

    3.12. When performing work not covered by current prices (changes in process technology, introduction of new materials, etc.), it is allowed to apply standards by analogy or draw up single prices, drawn up in the prescribed manner and approved by the customer.

    3.13. If during the restoration process unaccounted for types and volumes of work are identified, the contractor draws up local and performance estimates based on Acts of hidden and newly identified work.

    4. Preliminary work

    4.1 Preliminary work is carried out with the aim of developing Terms of Reference for carrying out work on a monument of monumental sculpture in accordance with the decision of the Restoration Council (restoration and conservation or emergency work, individual studies or comprehensive research work) and preparing documents to determine the estimated cost of these works.

    4.2. The customer organizes the development of technical specifications and can entrust the preliminary work to a contractor specializing in the field of restoration of monumental sculptures and having the appropriate license for restoration activities.

    Preliminary work can be performed by the contractor on the basis of a separate agreement with the customer or a letter of guarantee and must subsequently be included in the consolidated estimate for the restoration of the monument as a whole or a separate stage of restoration.

    4.3. Based on the results of the preliminary work carried out, a “Report of the technical condition of the monument” is drawn up. The structure of the “Act” includes the following sections corresponding to the composition of preliminary work on the monument:

    Analysis of information about existing documentation on the monument;

    Results of preliminary field inspection (defect sheet);

    Measurements of the monument, determination of the volume of restoration work (statement of quantities);

    Terms of reference for carrying out work on PMS.

    4.4. An analytical review of existing documentation on PMS involves familiarization with research, design and execution documentation on historical and archival research that has taken place, surveys of the state of PMS, restoration and repair work.

    The customer is obliged to provide the performer of these works with the opportunity to familiarize himself with the archival materials at the customer’s disposal on PMS (restoration reports and passports, protocols of restoration councils, survey reports, etc.).

    4.5. A preliminary full-scale inspection of the PMS is carried out to the extent necessary for drawing up a defective list and a technological scheme for restoration work (Technical Specifications). For this purpose, a visual field inspection of the PMS is carried out.

    A visual field survey establishes the features of the structural, technical and artistic state of the PMS as a whole and its individual elements, determines the nature of its changes over time, and the degree of accidents. A field survey is carried out from the scaffolding if the size of the monument requires it. The examination includes:

    Studying the state of preservation of the plastic sculpture, the causes and nature of losses, breakages, deformations, the presence and state of preservation of additions, reconstructions, etc.;

    Determining the technological features of making a sculpture: casting methods, joining parts, the nature of surface treatment (casting, forged, embossed, ground, polished, etc.);

    Identification of casting, welding, corrosion, mechanical defects, foreign inclusions;

    Identification of the degree and types of pollution and biocontamination of the monument;

    Determination of the state of preservation of protective, decorative and conservation coatings.

    Identified defects are described and entered into the “Defective List”, which is one of the sections of the “Certificate of the Technical Condition of the Monument”. It must reflect all detected defects of the alloy and stone (cracks, through holes, original and restoration inserts, chips, potholes, various types of contamination, etc.), their description and dimensions must be given.

    4.6. During the preliminary work, measurements of the PMS are carried out. Based on the measurements taken, schematic drawings are made illustrating the overall overall dimensions and dimensions of the individual structural elements of the PMS.

    Previously completed measurements of the monument available in the archives are copied with reference to the source used.

    4.7. During the preliminary work, it is necessary to take photographs of the PMS with recording of detected defects.

    4.8. The types and volumes of work on the monument, the need for which is established during the preliminary work, are entered in the “Bill of Scope of Work”.

    4.9. The “Act of the technical condition of the monument” is adopted by the Restoration Council and approved by the customer.

    4.10. According to the customer’s instructions, the “Certificate of the Technical Condition of the Monument” may include an estimate for the work. In this case, the “Bill of Quantities” is drawn up by the contractor in the prescribed form, agreed with the customer and transferred to the contractor for drawing up an estimate.

    4.11. If necessary, estimate documentation is prepared by specialist estimators on the basis of a contract with the contractor or customer.

    4.12. When carrying out restoration work on a monumental sculpture of low complexity and small volumes (vases, busts, etc.), it is possible to draw up Terms of Reference based on the decision of the Restoration Council without carrying out preliminary work. If it is necessary to take prompt measures related to damage, the consequences of acts of vandalism, accidents, etc. It is allowed to draw up a “Certificate of the technical condition of the monument” also without carrying out preliminary work. In this case, the documentation must contain sufficient information about the condition of the monument to draw up a program of priority repair, restoration, emergency and conservation work (Terms of Reference). The report is drawn up on the basis of a visual inspection of the monument and includes a description of the state of preservation of the monument and the identified causes of destruction.

    5. Specifics and types of destruction of monuments of monumental sculpture (PMS)

    5.1. The operating conditions of PMS in an open atmosphere significantly affect their state of preservation. Like architectural monuments, they have been exposed to climatic factors and corrosive gases from the industrial atmosphere for decades. In addition, the lack of routine care and unqualified restoration intervention negatively affect the safety of the PMS.

    5.2. The specificity and complexity of PMS restoration are determined by a number of factors related to:

    The variety of forms of artistic and plastic embodiment;

    The variety of materials used and the technology of their manufacture;

    Various options for engineering and design solutions;

    Harsh outdoor operating conditions;

    The variety of causes and types of their destruction.

    5.3. The main causes and types of destruction of PMS made of metals and alloys:

    The presence in the sculpture of numerous casting and welding defects, cracks, cavities, foreign inclusions, caused by imperfect manufacturing technology and the use of low-quality casting and sheet materials;

    Destruction as a result of atmospheric and other types of corrosion of the main and auxiliary materials of the monument;

    Destruction from the action of water (atmospheric and condensation moisture) associated with design flaws and lack of drainage;

    Surface wear as a result of the use of non-weather-resistant mechanically fragile protective and decorative coatings that require periodic replacement;

    Damage, breakage, loss, chips, failures as a result of mechanical influences.

    5.4. The main causes and types of destruction of PMS made of stone:

    Destructions caused by technological reasons, improper selection and use of materials with stone defects associated with the structure and physical and chemical properties of rock-forming minerals, and defects caused by deficiencies in mining and processing;

    Use of corrosion-resistant metal fasteners, etc.;

    Destruction as a result of atmospheric weathering, leading to loss of polish, cracks, delamination, peeling (desquamation), granulation, destruction of the surface layer;

    Surface destruction caused by biological factors.

    5.5. Causes and types of destruction of pedestals:

    Defects of technological origin: careless laying of blocks and slabs of stone; lack of waterproofing between the foundation and the pedestal; the absence of hidden drains of condensation water from the sculpture through the pedestal into the drainage system, the use of corrosion-resistant metals and alloys for attaching the sculpture and cladding slabs to the internal building structure, leading to contamination of the surface with rust streaks;

    The most common phenomenon is leakage of seams between blocks and facing slabs, which results in the penetration of moisture into the structure and the associated processes of destruction of the pedestal masonry and leaching of masonry mortars.

    6. Scientific research work (R&D)

    6.1. A common part. Research program. Development of restoration methods

    6.1.1 Scientific research work can be carried out in varying amounts depending on the status of the monument, the goals and scope of the proposed restoration work, the availability of documentation on previously completed research and the level of professional performance.

    Research work can be carried out either in the form of comprehensive studies, or in the form of studies on individual analytical, technological or historical and bibliographic issues.

    Research work is an integral part of the entire scientific restoration process. They begin at the stage of preliminary work and continue at all stages of the restoration of the PMS.

    Research of the monumental sculpture is carried out with the aim of:

    Rationale for the restoration work program;

    Development of restoration techniques - selection of restoration technologies and materials, taking into account the individual characteristics of the PMS.

    6.1.2. The research program is drawn up in accordance with the Technical Specifications for carrying out work on the monument of monumental sculpture. A comprehensive research program should include the study of all the main problems caused by the state of PMS.

    6.1.3. Before the start of research work, the performer is determined by the scientific supervisor of these works. The head of complex research and development of methods for the restoration of a monument can only be specialists with extensive experience in scientific and restoration activities.

    6.1.4. The scientific supervisor is responsible for the completeness (validity) and quality of the research and experimental work carried out. Coordination of scientific research work is carried out by the organization responsible for carrying out the scientific restoration of the monument.

    6.1.5. Based on the results of the study of the monument, a “Project of a methodology for the restoration of a monument of monumental sculpture” is being developed, which should regulate the sequence and content of restoration technological operations. The draft methodology is developed by the contractor.

    6.1.6. The draft methodology (with the attached license) is submitted for approval to the state authorities for the protection of monuments or to the customer of the work (depending on the status of the monument).

    Before approval, the draft methodology can be sent for examination to specialists from restoration and specialized research organizations. The examination period should not exceed two months.

    6.1.7. After making the necessary additions and corrections, the draft methodology is agreed upon as “Methodology for the restoration of a monumental sculpture (name of the work).” It contains conclusions from the results of scientific research and the methodology itself, which contains recipes, methods and sequence of all conservation and restoration operations.

    After approval, the methodology becomes an independent document, in accordance with which restoration work is carried out. Compliance with the provisions of the methodology is mandatory for performers.

    In cases of using previously developed methods tested at similar facilities, it is necessary to justify the possibility of their use at this facility.

    6.1.8. In cases where not comprehensive research is carried out, but individual types of research, a draft methodology is developed based on the conclusions of specialists on the research conducted.

    6.1.9. The methodology is the main document defining the nature and technology of conservation and restoration work. During the restoration process, additional defects may be revealed that are sometimes impossible to detect during preliminary studies. In this regard, it is necessary to change or supplement some points of the methodology. Changes and additions to the methodology are agreed upon by the Restoration Council and recorded in acts.

    6.2. Composition of research works

    6.2.1. The complex of research works includes:

    Archival, bibliographic and iconographic research;

    Field inspection of the monument and photographic recording;

    Research of basic sculptural materials and restoration inserts, finishing touches, fasteners and frames;

    Study of the composition, structure and state of preservation of protective and decorative coatings;

    Study of the mineral and chemical composition, structural features, degree of preservation and degree of salinity of the stone;

    Investigation of the composition of pollutants and biological research;

    Study of design features (frame, etc.);

    Engineering-geological research;

    Experimental work to prepare a draft restoration methodology.

    The research program for individual stages of restoration may contain one or more types of research in accordance with a specific technological task and the state of the PMS.

    6.2.2. The research work also includes the development of methodological proposals for bringing the PMS to an exhibition form (feasibility, concept and technology for masticating large defects, toning, recreating lost fragments of the monument or making copies).

    When developing proposals for bringing the monument to an expositional state, it is necessary to proceed from the fact that the reconstruction of lost fragments of the monument is not always the goal of restoration work.

    6.3. Carrying out research and scientific-experimental work to prepare a draft restoration methodology

    6.3.1. Archival, bibliographic and iconographic research.

    Historical-archival, bibliographic and iconographic research includes the identification, collection and study of archival, literary and illustrative materials on the history of creation, manufacturing technology, previous research and restorations stored in archives, libraries, museums, restoration workshops and other institutions.

    Historical information is compiled based on archival and bibliographic research materials, which is included in research reports.

    If at the stage of preliminary work or in the process of carrying out research in the materials on the PMS, the presence of historical information is revealed, completed in sufficient volume and at a good professional level, the research report should provide a link to the previous documentation with the addition of information on the history of the existence of the PMS in recent years .

    6.3.2. Field survey.

    When conducting a field survey, the degree of preservation of various materials of the monument is studied, for which non-destructive and laboratory (chemical, physical-chemical, etc.) types of research are used. Considering the complexity of sampling from a sculptural monument, preference in research should be given to modern non-destructive methods of analysis (ultrasonic, optical-analytical, etc.).

    If sampling is necessary, the following rule should be observed: the sample should be minimal and taken in the least critical or inaccessible places for review. Samples should be collected by an experienced conservator together with a laboratory member or specialist researcher.

    6.3.3. Research of metals and alloys.

    The study of metals and alloys from which sculpture, seams, finishing touches, frames, fasteners, etc. are made is carried out using chemical, physicochemical and metallographic analysis. The study of the chemical composition and structure of materials is necessary to justify the choice of methods for sealing defects, protective and decorative treatment, and manufacturing experimental samples. Samples are taken in the form of scrapings or small cuts, shavings, sawdust using a squeegee, drill, or ultrasonic scalpel.

    6.3.4. Coating research.

    The study of the composition, structure and state of preservation on sculptures made of metals and alloys of natural and artificial patina, surface layers and corrosion products is carried out using various physical, chemical and optical methods in order to substantiate fundamental decisions on the preservation or removal of artificial patina, assessing the condition of the surface, and choosing removal methods old and applying new protective and decorative coatings.

    During the field survey, locations are determined for trial clearing in order to establish the number of layers and the nature of various coatings on metal and stone.

    Test revealing (clearing) the patina from layers, dirt, paint, etc. make it possible to obtain information about the safety and presence of natural patina at a certain stage of formation.

    6.3.5. Stone research.

    The study of the mineral and chemical composition, petrographic characteristics of the stone, the quantitative and qualitative content of water-soluble salts, the composition of the destruction products of the surface layer is carried out in order to determine the degree of physical and chemical weathering of the stone and to develop methods for clearing, sealing defects, structural strengthening and conservation.

    6.3.6. Biological research.

    Includes mycological and bacteriological examination of all elements of the PMS: sculpture, pedestal, blind area, borders, etc. They are carried out to determine the degree of infection by fungi, bacteria, algae and to identify the role of microorganisms in the processes of destruction of the surface layer of the stone, peeling, delamination, formation of stains and deposits, color changes, etc. Based on the study, a conclusion is made about the need to use biocides and recommendations are given on the selection of restoration materials taking into account their biostability.

    6.3.7. Engineering-geological research.

    Provide for the collection and assessment of geological and hydrogeological conditions in the territory of the PMS and include:

    Study of the geological structure of the site;

    Hydrogeological study to clarify the depth of groundwater;

    Study of the composition and condition of foundation soils;

    Data on the design features of the monument, type of foundation, load distribution on foundation soils;

    Data on the nature of deformations and the rate of their development;

    Materials from observations of the settlement of the monument and its elements.

    In order to determine the geometric dimensions and condition of the foundation materials, its depth, the presence of waterproofing, and identify the type of foundation, exploration pits are dug. When examining foundations in pits, the type of foundation material, its shape, size and depth, characteristics of the stone and mortar, the presence of traces of weathering, leaching of stone and mortar, cracks and local destruction are determined.

    When studying the foundation masonry, it is necessary to determine the uniformity of the masonry and the approximate strength of the stone and brick.

    To carry out all these studies, a site plan and a situation plan indicating the PMS area at the appropriate scale are required.

    6.3.8. Based on the research results, taking into account the requirements for restoration technologies and materials, scientific and experimental work is carried out.

    It includes:

    Experimental testing of existing methods in restoration practice as applied to this monument. The results of such a check should form the basis for selecting the most effective technologies and clarifying the latter in accordance with the conditions of the restoration;

    Development of new techniques that have not been used anywhere before, taking into account the individual characteristics of PMS. All new materials must be tested in one of the research laboratories to ensure compliance with basic restoration requirements (frost resistance, light resistance, etc.).

    6.3.9. Experimental work on testing restoration materials and technologies should, at the first stage of work, be carried out on metal and stone samples similar to the original ones.

    6.3.10. To test the application modes and concentrations of a particular restoration material, experimental work is carried out in the least critical areas of the PMS.

    6.3.11. Trial openings (clearings), as well as recipes and the method of performing experimental work on the monument must be described in detail in the workbook and report. Experimental areas are recorded in photographs, drawings or PMS cartogram diagrams.

    6.3.12. The results of research and scientific-experimental work are summarized in a report on research work or issued in the form of conclusions on certain types of research.

    7. Rules for conducting restoration and conservation work

    The basic rule for conducting conservation and restoration work is the validity of each intervention in the current state of the monument

    7.1. Rules for conducting restoration and conservation work on monuments made of metals and alloys

    7.1.1. Removing surface contaminants.

    The first and mandatory stage of restoration work on PMS is the removal of surface contaminants: dust, cobwebs, soot, bird droppings, degraded coatings, loose corrosion products, grease and wax films, etc. This makes it possible to better identify existing defects.

    For this purpose the following are used:

    Dry cleaning by hand using bristle brushes or vacuum cleaners;

    Washing with solutions of neutral synthetic detergents of complex action with high cleaning power at low concentrations, low temperatures and any water hardness;

    Washing with aqueous solutions (emulsions) of organic solvents, etc.

    It is unacceptable to use products that can lead to the destruction of the natural patina on the surface of a metal or alloy.

    7.1.2. Elimination of defects.

    One of the main and most difficult stages of restoration work is the elimination of defects of various origins:

    To ensure the possibility of obtaining uniform and weather-resistant coatings, all finishing touches, inserts, fastenings, etc. should be made of an alloy identical in composition to the main one;

    Previously used foreign materials (for example, on a sculpture made of copper and its alloys - iron, lead, tin-lead solders, putties, etc.) during restoration must be replaced with corrosion-resistant materials;

    Add-ons, inserts, etc. must be attached either by welding (for example, using laser welding machines) or by mechanical connections that ensure tightness, but not by soldering (for sculpture made of copper alloys). For zinc sculpture and knockout sculpture consisting of soldered sheets, soldering individual inserts is quite acceptable;

    To avoid the formation of foci of local corrosion of the alloy and deterioration of the quality of protective and decorative coatings, cracks, fistulas, cavities, old foci of corrosion, etc. are drilled and removed, followed by welding, installation of patches, threaded plugs, rivets, etc.

    7.1.3. Making up for losses.

    In the absence of analogies, small replenishment of symmetrical elements or replenishment by the so-called “by inertia” method is possible in cases of violation of the integrity of the artistic perception of the sculpture.

    It is necessary to make up for the losses of individual elements of the sculpture to ensure structural strength.

    When manufacturing finishing touches and inserts, the following technological requirements must be observed:

    Replenishments must be made of metals and alloys identical to the main sculptural material;

    Cast inserts must be made using the same technique as the sculpture itself;

    7.1.4. Strengthening structural strength.

    The patina must be continuous, uniform and uniform in thickness, density, color, transparency, chemical composition, without loose areas, foreign inclusions and scratches. It should not contain compounds that dissolve in atmospheric water, actively react with it, condense moisture from the environment or adsorb aggressive substances that can react with patina or copper alloy.

    7.1.6. Protective and decorative treatment of sculptures made of cast iron and other metals with paint and varnish coatings.

    Before applying a new coating, all contaminants, corrosion products, and old degraded paint and varnish coatings are removed from the surface. All alloy defects must be eliminated.

    Paint and varnish coatings must be multi-layered with the obligatory use of two-layer primers, ensuring the creation of an anti-corrosion layer of the coating and its good adhesion to the base.

    The option of applying a multi-layer paint and varnish coating must be tested on experimental samples and approved by the Restoration Council.

    Coating quality control.

    The coating must be continuous, even, of equal thickness over the entire surface, and have good adhesion to the base. The coating should not have drips, sagging, scratches, cracks and wrinkles, peeling, pores, bubbles, lumpiness (“orange peel”). All coating defects are a violation of its application technology (for example, sagging, wrinkles) and a consequence of poor surface preparation (delamination, pores, etc.).

    If any coating defects are found, they must be corrected.

    7.1.7. Protective and decorative treatment of sculptures made of stainless steel, aluminum and their alloys without coatings.

    Indications for restoration are:

    Change in the original decorative qualities of the surface of a polished sculpture: darkening, tarnishing and changing the color background, the appearance of dark or colored contrasting spots, tarnish, etc.

    8. Organization of the restoration process at the site

    8.1. Restoration organizations engaged in the restoration of monuments of monumental sculpture must be equipped with all the equipment, inventory and materials necessary for this purpose.

    8.2. Restoration of monuments of monumental sculpture is carried out at the places of their permanent exhibition, in the warm season or in stationary conditions if dismantling is necessary.

    8.9. The progress of restoration and its results should be recorded in the work log and other restoration documentation, as well as in the final report.

    9. Scientific and restoration documentation

    9.1. The scientific and restoration documentation includes:

    9.4. The research report is signed by the manager and performers, after which it is transferred to the customer.

    9.5. Based on the results of the research work and in accordance with the submitted report, the customer, if necessary, clarifies the previously formulated provisions and requirements of the relevant sections of the Terms of Reference for research and restoration. If necessary, the new edition of the “Assignment” may provide for scientific research and experimental work accompanying restoration work. A report on this type of research can be prepared independently or included in the final report as an intermediate section.

    Note. This structure of the research report provides for the conduct of research and experimental work under the full program. In cases where only certain types of research are carried out, their results are presented in the form of conclusions. The conclusion is signed by the responsible executors and the work manager.     9.7. Photographic recording of the object being restored is required. It records the general appearance of the monument (and its fragments), showing the degree of preservation of the monument and the nature of destruction.

    9.8. General requirements for photographs:

    9.10. The reporting document for the restoration of monumental sculpture monuments that are small in size and volume can be a restoration passport used for movable historical and cultural monuments (as applicable).

    9.11. The deadline for submitting the final reporting documentation is no later than 3 months after acceptance of the work by the commission (Article 45, paragraph 6 of the Federal Law on Cultural Heritage Objects of June 25, 2002 No. 73-FZ).

    10. Control over the production of restoration work

    10.1. State control over the timely and high-quality implementation of conservation and restoration work is carried out by state bodies for the protection of cultural heritage sites

    10.3. Scientific and methodological control over the conduct of conservation and restoration work directly at the site is carried out by the Restoration Council.     10.4. The task of scientific and methodological control is to ensure compliance with the methodological principles of conducting restoration work, monitoring the practical implementation of the approved methodology for conservation and restoration work.

    10.5. The Restoration Council considers and resolves methodological issues of conducting restoration work, determines the assignment for restoration, the program of scientific research work, the methodological orientation, the order and nature of each stage of conservation and restoration work, checks their quality and professional level, compliance with the methodology, timeliness and reliability of documentary recording , monitors the implementation of methodological recommendations.

    10.6. The results of the work of the Restoration Council are formalized in the form of conclusions or protocols signed by all members of the council and brought to the attention of monument protection authorities, the customer, the contractor and other interested organizations.

    10.7. The head of the restoration team is required to submit working documentation for each meeting of the council - photographs and other documentation on the scope of work submitted to the council for consideration.

    11. Delivery and acceptance of completed restoration work

    11.1. The delivery and acceptance of completed restoration work on a monument of monumental sculpture is carried out respectively by the head of the work and the Restoration Council (commission).

    11.2. For delivery, all necessary documentation must be prepared with the assignment, research report, methodology, minutes of all meetings held at the site, photographic documentation, analysis results, and expert opinions.

    11.3. Based on the results of delivery and acceptance of restoration work, an act or protocol is drawn up with a mandatory assessment of the professional level of the restoration performed. The act (protocol) is signed by all members of the Restoration Council.

    11.4. Acts (protocols) of newly identified and hidden defects are presented to the Restoration Council for signature. In case of a dissenting opinion, a member of the commission puts his signature with his reasons.

    11.5. Restoration work is considered completed only after the completion of the Acceptance Certificate (protocol) for completed work.

    11.6.     12. Responsibility for the safety of the restored work of monumental sculpture. Operation and routine care
